Preamble
These General Conditions of Sale govern the relationship between the company CERAMICBYMANON and customers wishing to make a purchase on the site www.ceramicbymanon.com
Section 1: Presentation
CERAMICBYMANON is a brand of ceramic objects, tableware and art objects.
Article 2: Purpose
Any order implies full acceptance of these General Conditions of Sale, which are accessible and printable at any time by a direct and permanent link on this site.
These general conditions of sale shall prevail over any other general or specific conditions not expressly approved by Delrieux Manon.
Delrieux Manon reserves the right to modify its general conditions of sale at any time. In this case, the applicable conditions will be those in force on the date of the order by the customer. These general conditions of sale were updated on February 10, 2023 and are established in accordance with law n° 2014-344 of March 17, 2014 relating to the consumer code.
Article 3: Essential characteristics of the products presented on the site
The items offered for sale are handcrafted creations, they are unique pieces and they belong to collections created by CERAMICBYMANON. A product sheet specifies the essential characteristics of each product offered for sale on the online store.www.ceramicbymanon.com.
The photographs in the catalog are as faithful as possible but cannot ensure perfect similarity with the product offered, particularly with regard to colors.
These pots are works of art, and therefore for decorative purposes. Consequently, if the hole in the neck of the jars is closed, no refund or exchange can be demanded for this reason.
These thin-necked pots are in no way utilitarian, so it is not recommended to put water inside, because with wear it could end up locked up and stagnate.
Although stoneware is a resistant material, the necks are a fragile part of the pieces, a simple shock could break them. Handle them with care.
All images and texts presented on the site www.ceramicbymanon.com are reserved under copyright and intellectual property rights; their reproduction, even partial, is strictly prohibited.
Article 4: Price
The prices appearing on the online store are net prices expressed in euros All taxes included, the shipping costs are added at the end of the order just before the payment according to its destination.
CERAMICBYMANON reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalog on the day of the order will be the only one applicable for the customer.
Article 5: Orders
The online store site clearly shows which means of payment are accepted. Any order will only be considered after acceptance of payment.
Confirmation of the order entails acceptance of these General Terms and Conditions of Sale, acknowledgment of having perfect knowledge of them and waiver of the right to invoke its own conditions of purchase or other conditions. All the data provided and the recorded confirmation will constitute proof of the transaction. Confirmation will be worth signing and acceptance of transactions. The seller communicates to the customer by email confirmation of the registered order. CERAMICBYMANON reserves the right to cancel or refuse any order from a customer with whom there is a dispute relating to the payment of a previous order.
Article 6: Withdrawal
If a product does not correspond to the customer's expectations, the latter has a withdrawal period of 10 days from the date of receipt of the product to return it for a refund or an exchange. In accordance with art. L.121-21 and following of the consumer code the customer has a right of withdrawal of 10 days.
An acknowledgment of receipt of the withdrawal will be provided to the buyer by email.
Items returned in new condition and without having undergone transformation will be refunded or exchanged by bank transfer, including the delivery costs paid at the time of the order. This reimbursement will take place no later than 14 days from the date on which Delrieux Manon is informed of the withdrawal.
Exchanges must be the subject of a written request from the client.
Reimbursement may however be deferred until receipt of the product or until receipt of proof of shipment of the product by the customer.
The costs of returning an order are additional costs borne by the customer and are not reimbursed.
Custom models made to order are excluded from the right of withdrawal.
To protect an item during transport, it must be placed carefully in its original packaging or in suitable cardboard packaging (do not use a paper envelope) and addressed to:
DELRIEUX Manon, 29 rue Chastel, 13100, Aix-en-Provence. The costs and risks of transport being borne by the customer.
Article 7: Methods of payment
Payment is due upon order.
The shop offers a secure payment service by credit card to pay for your purchases. The order is only taken into account after complete validation of the payment and only during working days. An order confirmation email will be sent within 24 hours.
Article 8: Deliveries
The preparation and shipping time for all orders is 3 to 8 working days (unless there is a problem with the carrier).
The products are insured by the seller during delivery and until receipt at a relay point.
Deliveries are made all over the world, shipped by Mondial relay in France and in some European countries. It is therefore up to you to pick up your package at a relay point, no exchange or refund can be required if the customer exceeds the retention period.
Article 9: After-Sales Service
Within 6 months, Manon Delrieux will study requests for repair or replacement of items ordered on a case-by-case basis. If Manon Delrieux believes that her liability is engaged, the brand will offer to repair or replace a damaged product with a similar item of equivalent value.

Article 10: Intellectual property
All elements of the CERAMICBYMANON brand website are and remain the exclusive intellectual property of Manon Delrieux. No one is authorized to reproduce, exploit, redistribute, or use for any purpose whatsoever, even partially, elements of the site whether software, visual or sound.
Any simple or hypertext link is strictly prohibited without the written consent of Manon Delrieux, creator of the CERAMICBYMANON brand.
Article 11: Personal data
In accordance with the law relating to data processing, files and freedoms of January 6, 1978, personal information relating to customers may be subject to automated processing.
The CERAMICBYMANON brand reserves the right to collect information on customers, including by using cookies, for statistical analysis, under no circumstances will this data be transmitted to third parties.
Users have a right to access and rectify data concerning them, in accordance with the law of January 6, 1978.
Article 12: Archiving - Proof
CERAMICBYMANON will archive orders and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of article 1348 of the Civil Code.
The computerized registers of RAPHAELLE D'AUXERRE will be considered by the parties as one of the means of proof of communications, orders, payments and transactions between the parties.
The CERAMICBYMANON brand will also keep all order confirmations and invoices for 5 years.
Article 13: Applicable law
These General Conditions of Online Sale are subject to French law.
In the event of a dispute, jurisdiction is assigned to the competent court chosen by the customer, which may be either at his place of residence, or at the place of performance of the contract, or even at the place of residence of the seller's registered office.
